When should I instruct a conveyancing solicitor?

One of the most common delays to any property sale or purchase is not instructing a solicitor right away… Now, we’re not talking about instructing a solicitor as soon as the ‘SOLD’ board goes up, or even when you’ve negotiated and agreed a sale. We’re talking way before then! You should be doing instructing your conveyancer now. And here’s why…

If you’re buying, you could save 1 – 2 weeks on the time to complete by instructing now

Whether you’re buying or selling (or both!), instructing a solicitor now will save you time once you are ready to proceed with an offer. Instructing a solicitor right at the beginning of your journey means they can deal with the money laundering requirements of verifying your identity right from the start, saving you around 1 -2 weeks of time than if you instructed them at the point of proceeding with an offer.

If you’re selling, instructing your solicitor when you instruct your agent could save you 3 – 4 weeks

If you instruct your solicitor at the point of placing your property on the market, they can deal with the money laundering requirements of verifying your identity at the onset. These checks need to be made before lawyers can start the conveyancing process.

This includes:
the verifying of your identity,
your source of funds (if you are buying a home), and
carrying out electronic checks against you.

Having done this, you will then be able to take your time to collate information about the property and fill in the forms that you will need to complete.

Property Information Form

Leasehold Information (if the property is a flat/apartment)

Fittings & Contents Form

Having prepared all these will mean that your solicitor can issue a contract package very quickly to your buyer’s solicitors once you have accepted an offer for a house.

Also, if your solicitor is thorough, this will enable any potential problems to be brought to light in advance of a sale being agreed, thus enabling a smoother and slightly less stressful conveyancing process.
